If you accept payments that are less than the full amount of rent (including any applicable late fees) than your timeframes start over for dealing with an eviction. In Washington State, you have to first issue a 3 day pay or vacate notice once the tenants default. If they do not pay by the date, then you have to schedule a hearing to obtain a writ of restitution and a judgment for back rent, late charges, costs, and attorney fees.
I used to allow my tenants to deposit their rent checks directly into my account. However I found at that if I accept less than the total amount I am owed, I have to start back at the 3 day pay or vacate notice point. My attorney shared with me a horror story about a tenant who was familiar with the law. They waited until the day they were scheduled to go to court and they deposited $1 in the account of the Landlord. The judge threw the case out and told the Landlord he would have to reissue a pay or vacate notice and reschedule a court date (which can take 15-60 days).

I have invested in many tax lien properties and it is not just a bunch of hype. If you do you homework before you invest it can give you a significant ROI. Too many get greedy, impatient and lazy and end up stuck with a piece of property with no value. Like any other investment, if you are diligent in identifying the risks and potential returns, it can be an excellent investment.

Knowing what business to invest in seems to be the big, big challenge. Questions to be addressed include:
1. Will I run out of cash in the first few years like so many growing businesses do? 2. What will my rate of return be on my investment? 3. How much growth can the business sustain before there are cash shortages or need for capital restructuring? 4. How do I know what the value of the business I buy will be three years from now? 5 Perhaps most important is How does the business stand against its peers in the marketplace today? Can you explain the difference in tax structure between sole-proprietorship or incorporating? The business I seek to purchase is a small motel/rv park. I was thinking of incorporating as a LLC to protect my family assets, however, the seller suggests remaining sole-proprietor because there is less taxes to pay. The business is small and we will not have employees. Please advise.

I am negotiating a commercial property purchase with established motel. Seller will carry contract. He's very amiable, has presented himself as well-established businessman with over 30 decades of experience owning various businesses. As we discussed interest rate and length of the loan he adviced that we "never pay it off - that way you'll always have a tax break." What are your thoughts on this logic? I'd say that a $899K loan at 4.0% APR will be over 1 mil in 30 years and that's a sufficient sale price to him. I'll be mid 70's and likely ready to sell or pass on to decendents.

I've also had luck with lease options. However I often find myself torn between the role of being a landlord (looking for the highest possible profit) and helping these people out. I've found that without some prodding from me, my lease option tenants will not do the things they need to do in order to be able to purchase the home. This is great for me as the owner, because I get to keep the appreciation. However I can't help but feel a little bit like I'm taking advantage of these people by not helping prod them in the right direction.

I had never heard of a Business Broker but I was referred to one in October, 2005. My goal was to purchase a traditional business and although I knew what kind of results I wanted to have in owning my new business, I had no idea what kind of business I should purchase. My Business Broker helped me identify what was important to me, first. What kind of features and benefits did I expect to enjoy from being a business owner? Once that was determined, I was able to evaluate only franchises that would fit my expectations. The process of elimination was refined, concise and efficient....plus a lot of fun. I highly reccommend using a Franchise Consultant or Business Broker if you are looking to purchase a franchise.

Ah, those were the good old days, when the dart strategy actually worked. Now it takes a lot of work to find the next big stock. I'm personally getting a little weary though when it comes to the stock market overall. With the 80 million baby boomers that are nearing retirement age, and who will need to access their funds fairly soon, I don't see how the stock market can avoid a huge dip. After the 9/11 market crash investors overall I think have become much more gun shy as well and are ready to jump ship at the slightest downward movement in the market. As these boomers get closer to retirement age I see them moving their money from the more risky stocks and funds into more secure investments. That along with the whole mandatory distribution thing when people turn 70.5, I just fell that the market is going to take a big hit. I'm still investing in the stock market, but the stress level associated with those investments is a lot higher then it is with my real estate ones.

As someone who has bootstrapped several start-up business, I can tell you financing with bank loans can be difficult (even SBA loans). Typically they require you to have 2-3 years of history. The one exception is with franchises. My wife and I obtained SBA loan financing for a franchise purchase by using the historical location data, combined with a refined business plan provided by the franchisor.
In other words, if your goal is to fund a start up your options are home equity, credit cards, loans from friends and family, and retirement funds. |
